Fraternal greetings.
Please find below Dossier 2 on the judicial fraud committed against our Party.
In this document you will find the analysis of the illegal Sentence N° 1160 issued by the Constitutional Chamber of the Supreme Court of Justice (TSJ) on August 11, 2023, which consummates the judicial interference in the PCV and represents an assault on the PCV by the government of Nicolás Maduro.
In document below, the team of lawyers in charge of the legal defense of our party, dissects the lies contained in the judicial Sentence N° 1160, and demonstrates how Constitutional rights and laws of the country were violated to commit the illegal act.
This is a very serious act that establishes a very dangerous precedent for the right of the working class to independent political organization.
Its executors are not the ultra-right forces, nor the parties of traditional social democracy, but a government and party that calls itself “anti-imperialist” and progressive. This is a fact that should not surprise the Communist, workers and anti-imperialist parties of the world, because we have enough demonstrations in our history of the role played by this type of social-democratic forces against the interests of the workers and their political rights, when the crisis worsens.
The Constitutional Chamber of the Supreme Court of Justice has decided to disregard the decisions of our 16th National Congress (November 3-5, 2022) and to appoint an intervention board composed of persons outside our Party, on the basis of a document for which no evidence was presented, introduced by persons recognized ṕublicly as militants of the PSUV and other pro-government organizations, ignoring the defense brief and the evidence presented by the PCV, and denying us the constitutional right to defense in an oral trial.
A judicial decision has been made on the basis of an arbitrary and authoritarian abuse of power. What has happened is very serious and grave, and it poses future risks for the militants of the Communist Party of Venezuela and the democratic rights of the whole working class.
We hope that this material will be useful to inform all your Party, militants, and anti-imperialist and revolutionary organizations of your country, about this infamous judicial assault that has outlawed the true PCV, and that it will serve for the denunciation and solidarity actions aimed at defending the Communist Party of Venezuela’s right to exist.
